In accordance with Section 213 of the Environmental Planning and Assessment Regulation 2021 (the 2021 Regulation), notice is given of the public exhibition of Draft Richmond Valley Council Section 7.12 (formerly Section 94A) Contributions Plan (As Amended) (the Draft Plan).
Subject to a Contributions Plan, section 7.12 (formerly section 94A) of the Environmental Planning and Assessment Act 1979 (the Act) enables Council to impose as a condition of development consent (and Complying Development) payment levy, based on a fixed percentage of the proposed cost of carrying out the development. Contributions collected are to be used towards the provision, extension or augmentation of public amenities or public services identified in a Schedule of Work with the Contributions Plan.
What has been amended?
Amendments to the Draft Plan include-
- updated legislative references throughout the Plan as a result of the decimalisation of the Act and commencement of the 2021 Regulation; for example section 94A is now section 7.12 of the Act,
- replace the Schedule of Works with a new schedule of projects, and
- reformatting of the Draft Plan.

The Draft Plan may be inspected at:
- Council’s Customer Service Centres in Casino & Evans Head (during normal office hours), and

from Monday, 22 April 2024 with written submissions being accepted until the end of Wednesday, 22 May 2024.
Any person may make written submissions on the Draft Plan by addressing them to the General Manager and delivering them by:
- post—to Richmond Valley Council, Locked Bag 10, CASINO NSW 2470, or
- email—to council@richmondvalley.nsw.gov.au , or
- on-line—by completing an on-line submission form, or
- hand delivery—by dropping them off to staff at the Customer Service Centres at Casino or Evans Head.
